These Terms of Service ("Terms") govern your use of TaleForge (tale-forge.com), operated by Dreams-Makers Studio ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

TaleForge is a SaaS creative writing platform that helps authors write novels, manga scripts, animation screenplays, and other creative works with AI assistance. The platform provides project management, collaborative editing, worldbuilding tools, a character bible, and AI-powered content generation using your own API keys (BYOK model).

2. User Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information during registration.
  • One person may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

3. Content Ownership

You own your content. All stories, characters, worldbuilding material, scripts, and other creative works you create on TaleForge are and remain your intellectual property. We claim no ownership rights over your content.

You grant us a limited license to store, display, and transmit your content solely to provide the Service. This license terminates when you delete your content or account.

If you publish content on the TaleForge Marketplace, you grant buyers the specific license terms defined at the time of listing.

4. Bring Your Own Key (BYOK)

TaleForge operates on a BYOK model for AI features. This means:

  • You are responsible for obtaining, managing, and paying for your own API keys from third-party AI providers (e.g., OpenAI, Anthropic, Google).
  • You must comply with the terms of service of each AI provider you use.
  • We encrypt your keys at rest and never share them, but you are ultimately responsible for the security and usage of your keys.
  • We are not responsible for charges incurred on your AI provider accounts.
  • You may revoke or delete your keys at any time from your account settings.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Generate, store, or distribute content that exploits minors
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated means (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service infrastructure
  • Impersonate another person or entity
  • Resell or redistribute access to the Service without authorization

6. Marketplace

TaleForge may offer a Marketplace where users can sell templates, worldbuilding assets, or other creative resources. Marketplace rules:

  • Platform fee: Dreams-Makers Studio retains a 10% fee on all Marketplace transactions. The remaining 90% is paid to the seller.
  • Sellers are responsible for ensuring they have the rights to sell their content.
  • Buyers receive the license specified in the listing. No refunds unless the content is materially different from its description.
  • We reserve the right to remove listings that violate these Terms or our content guidelines.

7. Payment Terms

  • Free accounts have limited features as described on the pricing page.
  • Paid subscriptions (Premium, Team) are billed monthly or annually via Stripe.
  • Subscriptions auto-renew unless cancelled before the end of the billing period.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Prices may change with 30 days' notice. Existing subscribers are grandfathered at their current price until their next renewal after the notice period.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.

8. Termination

  • You may delete your account at any time. This will permanently remove your data.
  • We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity.
  • Upon termination, your right to use the Service ceases immediately. You may request an export of your data before deleting your account.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that AI-generated content will be accurate, original, or suitable for any particular purpose.
  • We are not liable for any loss of data, revenue, or profits, or any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • You are solely responsible for the content you create and publish using the Service.

10. Indemnification

You agree to indemnify and hold harmless Dreams-Makers Studio and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or a notice on the Service at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of France and the European Union. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of France. For EU consumers, mandatory consumer protection laws of your country of residence may apply.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
